1. Acceptance of Terms
By accessing or using the BitPoet website (bitpoet.in) and our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
2. Services
BitPoet provides custom software development, website development, SaaS platforms, and ongoing support & maintenance services to businesses. The scope, deliverables, timelines, and pricing for each engagement are defined in a separate project agreement or statement of work signed between BitPoet and the client.
3. Intellectual Property
Upon full payment of all agreed fees, clients receive full ownership of the final deliverables created specifically for their project. BitPoet retains the right to use general methodologies, frameworks, tools, and non-client-specific code developed during the project. BitPoet also retains the right to display completed work in its portfolio unless explicitly agreed otherwise in writing.
4. Client Responsibilities
Clients are responsible for providing accurate project requirements, timely feedback, and necessary access to systems or content required for project completion. Delays caused by the client may affect project timelines. BitPoet is not responsible for project delays arising from late or incomplete information provided by the client.
5. Payment Terms
Payment terms are outlined in individual project agreements. Generally, projects require an upfront deposit before work commences, with the remaining balance due upon project completion or in milestones as agreed. BitPoet reserves the right to pause or withhold delivery of work in the event of non-payment.
6. Limitation of Liability
BitPoet's liability is limited to the total fees paid by the client for the specific project or service in question. BitPoet is not liable for any indirect, incidental, special, or consequential damages including loss of profits, data, or business opportunities arising out of or related to our services.
7. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of the engagement. BitPoet will not disclose client business information, data, or project details to third parties without prior written consent, except where required by law.
8. Warranty & Support
BitPoet provides a 30-day bug-fix warranty on all delivered work from the date of final delivery. This covers defects in the deliverables as per the agreed specifications. Changes to requirements, third-party service disruptions, or client modifications are not covered under this warranty. Ongoing support beyond the warranty period is available through a separate support agreement.
9. Termination
Either party may terminate a project agreement with written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. BitPoet will deliver all completed work to the client upon receipt of outstanding payment.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts in India.
11. Changes to Terms
BitPoet reserves the right to update these Terms and Conditions at any time. Changes will be effective upon posting to this page. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
